Эзэмшлийн газар дээрээ автомашин худалдаалж буй 15 ИААНБ-ын газар эзэмших эрхийг цуцаллаа

Нийслэлийн газар зохион байгуулалтын албанаас 2019 оны наймдугаар сарын 20-ноос 22-ны өдрүүдэд нийт 62 иргэн, аж ахуйн эзэмшилд өмчлөлийн газраа зориулалтын дагуу ашиглах тухай 3 хоногийн хугацаатай мэдэгдлийг хүргүүлжээ. Энэ дагуу наймдугаар сарын 27-ны өдөр гүйцэтгэлийн хяналтыг хийсэн байна.
Мэдэгдэл шаардлагын дагуу 62 иргэн аж ахуйн нэгж байгууллагаас 16 нь зөрчлөө арилгаж, 46 нь зөрчилтэй хэвээр байгаа нь Газрын тухай хуулийн 35 дугаар зүйлийн 35.3.2-т заасныг зөрчиж байгаа юм.    
Газар эзэмших эрхийн гэрчилгээтэй 15 ИААНБ-ын газар эзэмших эрхийг Газрын тухай хуулийн 40.1.6-г үндэслэн хүчингүй болгох болсныг мэдэгдлээ. Түүнчлэн өмчилж буй газраа зориулалтын бусаар ашиглаж ил задгай автомашин худалдаалж байгаа 31 ИААНБ-ын газар өмчлөх эрхийг хүчингүй болгох саналыг нийслэлийн Засаг даргад хүргүүлэх болсныг мэдэгдсэн юм.

НЗДТГ-ын Хууль, эрх зүйн хэлтсийн дарга А.Даваажаргал “Нийслэлийн засаг даргын захирамж гарч Монгол улсын нийслэлд хууль бусаар газар эзэмшиж байгаа болон газрыг зориулалтын бусаар ашиглаж байгаа зөрчлийг арилгах арга хэмжээнүүд зохион байгуулагдаад явж байна. Өнгөрсөн онд бид зөвшөөрөлгүй болон зориулалтын бус эзэмшил өмчлөлийн газар дээр автомашины худалдаа эрхэлж байсан ИААНБ-ын газар эзэмших эрхийг цуцалсан. Мөн тухайн газрыг албадан чөлөөлж байсан. Энэ ажил үргэлжлээд явна.
Эрхийг нь цуцлахтай холбогдуулан газрыг албадан чөлөөлөх ажлууд хийгдэнэ.
Нийслэлийн нутаг дэвсгэрт эзэмшлийн газар дээр автомашины худалдаа эрхэлж байгаа нийт 15 ИААНБ байгаа бол өөрийн өмчлөлийн газар дээр автомашины худалдаалж буй 31 ИААНБ байна. Нийслэлийн Засаг даргын захирамжаар байгуулагдсан ажлын хэсэг энэ 15 ИААНБ-ын үйл ажиллагаа, газар эзэмших эрхийг нь цуцлахаар ажиллаж байна. Эрхийг нь цуцлахтай холбогдуулан газрыг албадан чөлөөлөх ажлууд хийгдэнэ.
Нийслэлийн ерөнхий төлөвлөгөөний дагуу Улаанбаатар хотод автомашины худалдаа эрхлэх нэг цэгийг зааж өгч, түүнийгээ тохижуулсан байгаа. Энэ цэг одоо нээлттэй үйл ажиллагаагаа явуулж байна. Гэсэн хэдий ч иргэд маань Улаанбаатарын төвд автомашины худалдаа эрхэлж байгаа үйлдлүүд газар авчээ.
Иргэн хүний өмчилж авсан газрыг цуцлах эрх Нийслэлийн засаг даргад хуулиар олгогдоогүй. Гэсэн хэдий ч Монгол улсын Иргэний хуульд заасны дагуу газар өмчлөх эрхийг шүүхээр цуцлуулах боломж бий. Зориулалтын бусаар өмчлөлийн газраа ашигласан гэдэг үндэслэлээр дээрх 31 ИААНБ-ын газар өмчлүүлэх эрхийг цуцлуулах ажиллагааг өнөөдрөөс эхлүүлж, шүүхэд хандаж байна” хэмээлээ.
